HC Deb 16 July 1946 vol 425 cc1032-3
34. Sir John Mellor

asked the Minister of Fuel and Power why deductions are made, without their consent, from the wages of men directed to work in the Warwickshire coalmines; whether he is aware that these deductions are for the benefit of a pension fund in which they have no interest; and why the amount deducted is not refunded upon their release from the coal industry.

Mr. Shinwell

The deductions are made in accordance with an agreement between the employers and workers organisations in Warwickshire. A refund of contributions to men leaving the industry would be contrary to the terms of the trust deed under which the pension fund is established.

Sir J. Mellor

As these deductions are not made with the consent of the individuals, will the Minister say under what stautory authority they are made? Are they not illegal?

Mr. Shinwell

I understand that some time ago a ballot of the men in the coalfield was taken on this matter, and it was decided to proceed with this scheme. I am advised that any question as to the legality of the proceedings is a matter for the courts.
