asked the Chancellor of the Exchequer which official initiates prosecution under Sub-section (2) (a) of Clause 33 of the Finance Bill; who are the judges of innocent or guilty sellers of shares; to whom can an appeal be made; and who makes the final decision against which there is no appeal.

The provisions of Clause 33 of the Finance Bill amend the provisions of Section 35 of the Finance Act, 1941, and if my hon. Friend will refer to Section 35 he will see that it rests with the Commissioners of Inland Revenue if they think fit to issue directions under the Section. Any person aggrieved by a direction is entitled to appeal to the Special Commissioners of Income Tax, who may cancel or vary the direction. The decision of the Special Commissioners on appeal is final and conclusive except on a question of law, when it is open to either party to the appeal to require a case to be stated for the opinion of the High Court.
