HC Deb 17 October 1940 vol 365 cc812-3
72. Mr. Dobbie

asked the Minister of Pensions whether his attention has been called to the case of London and North Eastern Railway goods guard H. Truglia, who is suffering from shock as a result of four enemy bombs being dropped within a few yards of his brake-van; and whether he will give instructions that cases of shock should be brought within the definition of personal injury under the Personal Injuries Act, 1940?

The Minister of Pensions (Sir Walter Womersley)

The Personal Injuries (Emergency Provisions) Act, 1939, covers cases of shock which are associated with physical injury, including concussion, resulting directly from war operations. I have had careful inquiry made into the case of Mr. Truglia and am advised that at the time in question he was 350 yards from the nearest bomb explosion and suffered no physical injury therefrom.
