asked the Minister of Transport whether his attention has been drawn to the decision of the appeal tribunal in the McNaughton case, where an A licence was refused because he had changed the places to which he had previously been operating; and will he take legislative action to prevent a system of route licensing being imposed without the sanction of Parliament?

I am aware of the decision referred to by my hon. and gallant Friend, but I do not think that he correctly states the reasons for it. The appeal in question was refused not because the applicant had changed the places to which he had previously been operating, but because he had failed to produce any evidence of the need for the facilities for which he was applying. No question arises of the imposition of a system of route licensing such as my hon. and gallant Friend suggests.
