47. Mr. G. Hall

asked the Minister of Labour whether he is aware that the 750 workmen who were employed at the Gadlys colliery, Aberdare, and are now unemployed, have been refused unemployment benefit from two to six days for the reason that they received varying sums of holiday pay when they ceased work through the closing down of the colliery; and will he take steps to refund the benefit refused them for the reason given above?

The claims of these men were disallowed by the insurance officer on the ground that, notwithstanding that their employment had terminated, they continued to be in receipt of wages within the meaning of Section 35 (6) of the Unemployment Insurance Act, 1935, as interpreted by the Umpire, for as many days as the holiday payments represented in wages. I understand that the claimants have not exercised their right of appeal to the court of referees against the insurance officer's decision. I have no power to pay benefit except in accordance with the decisions of the statutory authorities.

As there are several points arising out of the reply, will the right hon. Gentleman discuss them with me afterwards?

Mr. Brown

I will gladly discuss any point at issue, but the hon. Gentleman will understand that this is the type of case to which we shall have to have special regard in framing any new regulations under the new Bill.
