23. Mr. Ellis Smith

asked the Secretary of State for the Home Department whether his attention has been directed to the observations made on 13th October, 1937, by Lord Hewart in the King's Bench Divisional Court, when dealing with an appeal by an inspector of factories against a firm who had not fenced dangerous machinery, which included a shaft turning at 190 revolutions a minute; and is it intended to take any action on the suggestions made by Lord Hewart in which Mr. Justice du Parcq and Mr. Justice Atkinson concurred?

Can the right hon. Gentleman explain why he treats with contempt the opinions of the Lord Chief Justice and his learned colleagues?

I never care to express an opinion in such cases.

Why does not the right hon. Gentleman take action in the matter?
