57. Mr. James Griffiths

asked the Home Secretary whether he is aware that the South Wales Coalowners Indemnity Society are refusing to pay compensation to men certified by the medical board to be disabled by silicosis; that the reason given for this refusal is that the society propose to institute proceedings for the purpose of seeking a declaration that the silicosis orders issued by him are ultra vires; and that meantime these men are compelled to seek public assistance; and what action he proposes to take in the matter?

I have no information to the effect suggested in the question. I should be prepared to consider any fuller particulars which the hon. Member may send me, but I have, of course, no power to interfere with any legal proceedings.

Mr. Griffiths

Does not the right hon. Gentleman consider it deplorable that the employers should try to seek advantage of some possible technical flaw in order to deprive of compensation men suffering from this disease; and will he give an assurance that, if the court hold that the Order is ultra vires, these men will not be penalised and that the Government will bring in a new Order to give them the compensation to which they are entitled?

I agree with the hon. Member that this is a matter of great importance. I would, however, rather not express an opinion until I have further facts.
