60. Mr. W. Roberts

asked the Under-Secretary of State for India whether he can give the House information as to the condition of health and place of detention of Mr. Saroj Mukherji, whether he is aware that this gentleman was released from gaol on 17th July last on completion of a sentence of 18 months' rigorous imprisonment on a charge of sedition and was immediately re-arrested at the gate of the gaol under the Bengal Criminal Law Amendment Act, 1930, and placed under detention; whether there is any evidence to show that Mr. Mukherji is or has been in any way associated with the terrorist movement; and, if not, whether Mr. Mukherji may be liberated?

The facts of this case are as stated. Mr. Saroj Mukherji is now in village internment in the Noakhali District. His case has been review by two judges who have advised that there is evidence of his association with terrorism which justified his detention. His health is reported to be not good and the possibility of transferring him elsewhere is under consideration. The local Government are not, however, prepared at present to release him.
