6. Sir John Wardlaw-Milne

asked the Secretary for State for Foreign Affairs whether he is aware that the decision of the Chinese judicial yuan in connection with the sale of mortgaged property in Shanghai only permits an auction without judgment provided the debtor or third party raises no question, and that this proviso enables defaulting mortgagors to postpone realisation without just cause; and will he therefore take steps to secure the observance of the undertaking set out in the letter from the mayor of Greater Shanghai to the senior consul referring to the proceeding in connection with these mortgages.

Will the right hon. Gentleman bear in mind that the position to-day really is that the undertaking given to him by the Mayor of Greater Shanghai is not being carried out owing to the proviso always inserted, and referred to in the question?
