asked the Minister of Health whether he has considered the resolution by the Barrow-in-Furness Town Council deploring the action of retired medical officers of health in appearing against local authorities at inquiries held by the Ministry of Health; and whether, in the interests of public health and the rights of ratepayers, he will instruct his officers holding such inquiries to obtain the best evidence available whether from retired medical officers of health or otherwise?

I have received a copy of the resolution referred to, which relates to inquiries held by my inspectors into Orders made under the Housing Act, 1936. It is for the owners of property affected by such Orders themselves to decide what evidence they should produce at an inquiry, and I have no intention of doing anything to diminish their rights in this respect.
