68. Mr. GARRO JONES

asked the President of the Board of Trade in what circumstances his power, under Section 1 of the Sea Fishing Industry Act, 1933, to make new orders will cease on 28th July?

Mr. RUNCIMAN

Under Section 1 of the Sea Fishing Industry Act, 1933, the Board of Trade have power to make Orders regulating the landing of sea-fish. Sub-section (5) of this Section provides that any such Order shall cease to have effect at the end of three years from the commencement of the Act unless its continuance in force has previously been approved by resolutions in each House of Parliament. The circumstances in which the Board of Trade have power to make Orders regulating the landing of sea-fish after the end of three years from the commencement of the Act, that is to say after 28th July next, are set out in Subsection (4) of Section 1.

Is the right hon. Gentleman aware that by making Orders now which are of indefinite duration he is evading the restrictions which the Act of 1933 laid upon him?

Mr. RUNCIMAN

No, Sir, I certainly do not plead guilty to that charge.

Mr. GARRO JONES

Will the right hon. Gentleman bear in mind that the Act of 1933 places a limitation on his powers to make Orders and that those Orders have to come to an end in three years? If he makes Orders of indefinite duration now does it riot completely evade the whole purpose of that Act?
