HC Deb 20 April 1934 vol 288 c1275

I beg to move, in page 6, line 14, to leave out "to indemnity."

This and the following Amendment are purely drafting, as the words which are proposed to be left out are unnecessary.

Amendment agreed to.

Further Amendments made: In page 6, line 15, leave out "a payment by way of."

In line 37, at the end, insert: Provided that the High Court or Court of Session, as the case may be, may, upon application made by or on behalf of the insured, direct that the amount of any such debt as aforesaid due in respect of a payment which the insurer has become liable to make under any particular contract of insurance, shall be reduced by such amount as the court thinks proper, having regard to the amount paid or payable by the insured to the insurer by way of premium under the contract."—[Mr. G.
