32. Mr. BROCKWAY

asked the Secretary of State for India whether Mr. H. D. Rajah, who was sentenced at Bombay to 30 months' rigorous imprisonment on 30th October, 1930, and to a further six months' rigorous imprisonment on 7th November, 1930, under Section 124a of the Indian Penal Code and Sections 17 (1) and 17 (2) of the Criminal Law Amendment Act, respectively, is still in prison; and; if so, why he has not been released under the terms of the Irwin- Gandhi Agreement?

Mr. BENN

I have no information whether Mr. Rajah is still in prison. The decision as to the release of individual prisoners is one which I must leave to the authorities in India.

Will the right hon. Gentleman make inquiries into this case?

Mr. BENN

Every effort is being made by the Government and, I believe, by Mr. Gandhi, to carry out the terms. It would be better not to intervene, but to allow the discussion to take place in India.
