§ 18. Mr. PETHICK-LAWRENCEasked the Home Secretary whether his atten- 573 tion has been drawn to the remarks made by the Lord Chief Justice in the case of Rex v. Ely Justices, ex parte Mann, regarding the undesirability of a clerk to committing justices becoming solicitor for the prosecution; and whether he will introduce legislation to extend to county clerks the prohibition imposed on borough clerks by the Municipal Corporation Act, 1882?
§ Sir W. JOYNSON-HICKSI have read reports in the Press. I agree generally that the dual position is not desirable, but I hardly think there are sufficient grounds for proposing legislation to disturb the position that has existed since 1835 at least.
§ Mr. PETHICK-LAWRENCEWill the right hon. Gentleman keep his attention on the matter, in view of possible changes?
§ Sir W. JOYNSON-HICKSAny alteration in the law dealing with these matters I will very carefully consider.
§ Sir HENRY CAUTLEYCould a letter be sent from the Home Office to the Justices to the same effect?
§ Sir W. JOYNSON-HICKSI will consider that, but, as my hon. and learned Friend knows, Justices do not like being interfered with too much.
