HC Deb 18 November 1914 vol 68 cc431-2
18. Sir CLIFFORD CORY

asked whether it is the duty of every company incorporated outside the United Kingdom which establishes a place of business in the United Kingdom to comply with the requirements of Section 274 of the Companies (Consolidation) Act, 1908: whether the Registrar has power to enforce observance of such duties; and in what cases during the last twelve months such powers have been exercised?

Mr. RUNCIMAN

It is the duty of every company incorporated outside the United Kingdom which establishes a place of business within the United Kingdom to comply with the requirements of Section 274 of the Companies (Consolidation) Act. 1908. The provisions of the Section are enforced by the Board of Trade. Since the 1st January, 1914, the Board have been in communication with the representatives of thirty-four companies which have not complied with the requirements of the Section. Twelve of these companies are still in default, and proceedings will be taken in any case where the default continues, and I am advised that proceedings are likely to be successful.

Sir C. CORY

Is it not a fact that the Registrar has omitted to enforce that Section, and that he has only done so when it was brought before his notice?

Mr. RUNCIMAN

I would like notice of any question relating to the action taken by the Registrar previously.
