asked the Lord Advocate whether, in the event of the Teachers' Superannuation Scheme for Scotland not being confirmed this Session, he will consider whether the scheme when confirmed should be made retrospective so that no teacher who would otherwise have been entitled to the benefits of the scheme should suffer by the delay?

I would refer the hon. Member to paragraph 2 of the draft scheme, from which it will be seen that the new scheme is intended to apply to teachers who have retired on pension before the date of commencement of the scheme, as well as to teachers still in service.
