I beg to ask the Under Secretary of State for War whether Major A. Gybbon Spilsbury has been gazetted out of the Militia after 30 years' service, and has been refused a court-martial; and, if so, whether this action on the part of the War Office was determined by Major Spilsbury's connection with the expedition of the Tourmaline to the Sus country?

Yes, Sir; Major Spilsbury has been gazetted out. No question of a court-martial was raised. Major Spilsbury shipped a cargo of arms in the Tourmaline, and landed them at Morocco despite three warnings from the Foreign Office that his proceedings would not be countenanced. Having disregarded those warnings his services were dispensed with and no court-martial was necessary.
