I beg to ask the Attorney General whether it is in the power of a Secretary of State to make rules prohibiting the employment of any class of persons in a process certified by him to be dangerous or injurious to health, under section 8 of the Factory and Workshops Act, 1891, as amended lay section 28 of the Act of 1895?

The Secretary of State has no power to make rules as suggested by the Question of the honourable Member. Rules can be proposed by the Secretary of State or chief inspector, as the case may be, but they can only be established either by consent of the occupier of each factory or by arbitration.
