I beg to ask the Chief Secretary to the Lord Lieutenant of Ireland whether under 9 George IV., c. 82, s. 14, the chairman of the Towns Commissioners of Enniskillen is the returning officer for the election of Commissioners, and is thereby ineligible for re-election on the new board; whether he has received a resolution from the Enniskillen Commissioners requesting him to release the chairman from the disability by appointing the clerk of the Commissioners to be the returning officer; and will he cause rules to be framed for that purpose?

The Enniskillen Borough Improvement Act of 1870 does not appear to have repealed the section of the Act mentioned in the first paragraph, which provided that all the outgoing Commissioners should be eligible for re-election except the chairman, who should hold and preside at the election of Commissioners. The reply to the second paragraph is in the affirmative. Under the Local Government Board's draft rules for the election of urban district councillors it is provided that the clerk to the urban district council shall be the returning officer.
