I beg to ask the Lord Advocate upon what principle the Scotch Education Department now refuses to continue to pay the additional grant claimed by certain Scotch School Boards in virtue of that part of Section 67 of the Education (Scotland) Act 1872?

I understand the hon. Member's Question to refer to the case of scholars in evening schools. The Scottish Education Department has had the matter under its consideration, and has taken legal opinion. It is advised that in view of the fact that there is now no restriction of age in the case of scholars in evening schools, and as such schools are not part of the accommodation which it is compulsory on School Boards to provide, this attendance cannot be included in reckoning the average attendance in the sense of the section referred to.
