I beg to ask the Chief Secretary to the Lord Lieutenant of Ireland—(1) whether he is aware that at the recent Assizes for the County of Waterford the County Surveyor applied for and got permission from the Grand Jury to institute proceedings against Edmund Coleman, of Raspberry Hill, an evicted tenant, for the purpose of compelling him to remove a shanty or hut in which he has resided for more than 16 years, on the side of an old disused road which has been out of contract for the past 18 years; and, (2) can he state on what grounds the County Surveyor has taken action in the matter after a lapse of 16 years?

The facts appear to be as staled in the first paragraph, except that the road in question is not a disused road, but one on which there is considerable traffic. I have no knowledge of the reasons the County Surveyor may have had either for taking action now, or for having abstained from taking action in the past.
