I beg to ask the Lord Advocate, in view of the fact that in a Circular issued by the Local Government Board (Scotland) it is stated that, where a parish is partly landward and partly within a police burgh, the appointment of the representative for the landward part of the parish on the district committee of the county council falls to be made by the parish council, including the representatives of the police burgh, whether he will state if this is in accordance with the provision of Sub-section (7), of Section 19, of the Local Government (Scotland) Act, 1894?

I think that the Circular issued by the Local Government Board correctly states the effect of the sub-section referred to in the question. A parish which is partly landward and partly within a police burgh, is not, within the meaning of the Act, a parish partly landward and partly burghal; it therefore follows that the appointment of a representative from the parish council on the district committee falls to be made by the parish council.
