I beg to ask the Under Secretary of State for India whether, under the Bengal Tenancy Act of 1885, any limits are imposed as to the area within which the Government is empowered to make a compulsory survey at the expense of the landlords and tenants; and, if so, whether the Government of Bengal would be instructed to observe those limits in its operations in connection with the Behar Cadastral Survey?

Section 101 of the Bengal Tenancy Act of 1885 permits the Local Government to make a survey and record of rights in a local area without any limitation with the previous sanction of the Governor General in Council, and permits the local Government to do so without such previous sanction in four specified cases. Section 114 of the same Act provides for the defrayal of the cost of such operation, in either case, by the landlords and tenants. The Secretary of State is confident that the Government of Bengal are duly observing the requirements of the law in this matter.
