I beg to ask the Lord Advocate whether the late Procurator Fiscal of Morayshire gave any, and if so what, reasons for deciding not to take proceedings against John Andrew in what is known as the Fochabers Intimidation case?

I learn upon inquiry that the reasons for which the late Procurator Fiscal did not take proceedings were two—(1) because there was not sufficient evidence to establish the charge; and (2) because the Lord Advocate stated in the House of Commons in July, 1891, in answer to a question, that even if the allegations put in the question had been correct, there was nothing which amounted to undue influence as defined by the Corrupt Practices Act.
