I beg to ask the Attorney General for Ireland whether he is aware that, at the Wexford Spring Assizes, the tender of a man, named John Smith, who tendered to keep in repair a road in the Barony of Ballaghkeene North at the rate of 5d. per perch, was rejected, and the contract given to a man, named Tomkins, at 7d. per perch, although Smith and his sureties were perfectly solvent; and if he will explain why Smith's tender, which was the lowest, was not accepted, having regard to the provisions of the Irish Grand Jury Act and the cases decided thereon?

The facts are substantially as stated in the first paragraph of the hon. Member's question. I do not know, and I have no means of ascertaining, why Smith's tender was not accepted.
