Clause 3 (Application).

THE LORD ADVOCATE (Mr. J. M'LAREN)

moved, as an Amendment, in page 2, to insert at the end of the clause— The provisions of the Summary Jurisdiction Acts shall also apply to prosecutions under the Tweed Fisheries Acts: Provided always, That it shall he in the option of the prosecutor to proceed either under the forms of the Tweed Fisheries Acts, or under the forms of the Summary Jurisdiction Acts.

Amendment agreed to; words inserted accordingly.

On the Motion of the LORD ADVOCATE, further Amendment made, in page 2, line 21, by leaving out from "this" to "1864," and inserting "the Summary Jurisdiction Acts."

Clause, as amended, agreed to.

Clause 4 (Regulation of expenses).

MR. J. A. CAMPBELL

said, the scale of fees allowed by one of the clauses was so low as, perhaps, to amount to a discouragement of prosecution, and there fore to interfere with the course of justice.

THE LORD ADVOCATE (Mr. J. M'LAREN)

explained, that when the Bill was introduced in the House of Lords, some objections were made to the scale of fees, and a slight increase was made, and since then he had not heard that any complaint was made that the fees were too low.

Clause agreed to.
