asked the Secretary of State for the Home Department, Whether, at the last Manchester City Sessions, John Roberts was sentenced by the Assistant Barrister as an incorrigible rogue, under 5 Geo. IV. c. 83, sec. 5, to imprisonment for 12 calendar months with hard labour, and to receive 12 lashes with the cat, to be administered on two occasions; whether whipping under the section in question has not been long obsolete; whether there is any power to flog twice; and, whether the Secretary of State will suggest that this part of the sentence be not carried out?

in reply, said, that, at the same sessions at which the man was tried, the Recorder altered the sentence, and the whipping was remitted.
