rose, pursuant to notice, to move that— It is expedient that the mitigation effected in tile law of this country with respect to the Punishment of Death be extended to the Colonies. In many cases the colonial law was the same as that of the mother country; and, several colonies, in this respect, were similarly circumstanced as the United Kingdom, and there were a great number in which the law was much more severe: he contended therefore that the criminal law ought to be as nearly as possible assimilated throughout the whole of Her Majesty's dominions—when, notice having been taken that forty Members were not present,
