To ask the Secretary of State for Trade and Industry what assessment he has made of the effects on the employment rights of further education lecturers of the judgment in Credit Suisse First Boston (Europe) Ltd.v. Lister by the Court of Appeal on 16 October 1998; and if he will make a statement. [74699]

The Court of Appeal's judgment in this case is consistent with established case law of the UK courts and of the European Court of Justice. Following a transfer of an undertaking within the meaning of the Transfer of Undertakings (Protection of Employment) Regulations 1981 and the EC Acquired Rights Directive of 1977 (which the Regulations implement in the UK), changes to the terms and conditions of affected employees are unlawful if they are for a reason connected to the transfer. There are no special considerations relating to further education lecturers.
