§ Mr. RaynsfordThe Town and Country Planning Act 1990 requires local planning authorities to determine applications for planning permission in accordance with the development plan unless material considerations indicate otherwise. It is for local authorities to decide whether material considerations justify granting a planning permission that is not in accordance with the plan.
