To ask the Secretary of State for Health if he will list the health and safety legislation, including delegated legislation, which applies to children in schools. [59593]

I have been asked to reply.

The Health and Safety at Work, etc. Act 1974, is mainly concerned with workplace activities and the protection of workers and others who may be affected by such activities; this may include school children. In addition, the Management of Health and Safety at Work Regulations 1992, the Control of Substances Hazardous to Health Regulations 1994 and the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 have applications which cover children in schools. Also the Education (School Premises) Regulations 1996 cover the health, safety and welfare of school children.

I have been asked to reply.

There are no regulations under Health and Safety at Work, etc. Act 1974 which specifically cover the carrying of weights by children in schools. The Management of Health and Safety at Work Regulations 1992 require, amongst other things, employers to assess the risks arising from work activities which affect the health and safety of those not in their employment, such as school children. This may include any risks arising from manual handling.
