Mr. McNamara

To ask the Secretary of State for Northern Ireland if the judgment and the court papers in the David Adams case have been sent to the Director of Public Prosecutions. [31631]

[holding answer 27 February 1998]: I am informed that the Director of Public Prosecutions requested and obtained a copy of the Judgment in the case of David Adams v the Chief Constable of the RUC, which is presently being considered.

To ask the Secretary of State for Northern Ireland what disciplinary steps have been taken by the Chief Constable of the RUC against those RUC officers who assaulted David Adams whilst in custody following his arrest; and if they are still serving officers. [31630]

[holding answer 27 February 1998]: Following a complaint made on behalf of Mr. Adams in 1994, the Independent Commission for Police Complaints supervised an investigation into the circumstances of the arrest and detention. In October 1995 a dispensation was granted by the ICPC on the ground that it was not practicable to complete the investigation given the level of co-operation thus far provided by or on behalf of the complainant. In addition, a file was forwarded to the Director of Public Prosecutions who directed 'no prosecution' against any police officer.

The Chief Constable is studying the findings in the civil court proceedings.

I can confirm that the police officers involved in the arrest of Mr. Adams are currently serving in the RUC.
