To ask the Secretary of State for the Environment, Transport and the Regions how many manslaughter charges have been brought following fatal accidents at work in each of the last 10 years; how many have been brought against(a) employees and (b) managers; and how many have resulted in convictions. [54846]

Mr. Meale

The number of manslaughter charges brought following fatal accidents at work which have been investigated by the Health and Safety Executive (HSE), and the outcome, in each of the last six years is as follows:

To ask the Secretary of State for the Environment, Transport and the Regions how many manslaughter charges have been brought following fatal rail crashes in each of the last 10 years; how many have been brought against(a) drivers and (b) managers; and how many have resulted in convictions. [54845]

Mr. Meale

A train driver was charged with manslaughter and convicted following a fatal rail crash on 4 March 1989. Following a further fatal crash on 8 August 1996 charges were laid against a driver who was subsequently found not guilty. A driver has also been charged following a fatal crash on 19 September 1997. There have been no manslaughter charges brought against managers in this period.
