To ask the Secretary of State for the Environment, Transport and the Regions (1) if he will list the NHS trusts in Wales which(a) have been prosecuted under health and safety legislation and (b) have received prohibition or improvement notes since 1991; [51594]

(2) if he will list the NHS trusts in Wales which have been found since 1991 to be in breach of the Health and Safety at Work, etc. Act 1974; and if he will give details of the breaches. [51595]

[holding answer 22 July 1998]: Between 1 April 1991 and 31 March 1998, Mid Glamorgan Area Health Authority was prosecuted by HSE on 28 November 1991 for a breach of the Control of Asbestos at Work Regulations 5 and 8. South Glamorgan Area Health Authority was prosecuted on 28 February 1996 for a breach of section 3 of the Health and Safety at Work, etc. Act 1974. No other prosecutions have been taken in Wales.

Improvement Notices have been issued against the following NHS trusts by HSE's Field Operations Division in Wales between 1 April 1996 and 31 March 1998:

  • Bridgend and District NHS Trust
  • Carmarthen and District NHS Trust
  • Glan Hafren NHS Trust
  • Morriston Hospital NHS Trust
  • South East Wales NHS Ambulance Trust
  • Wrexham Maelor Hospital NHS Trust
  • Cardiff Community Health Care NHS Trust
  • Ceredigion and Mid Wales NHS Trust
  • East Glamorgan NHS Trust
  • Clwydian Community Health NHS Trust
  • Gwent Community Health NHS Trust
  • Powys Health Care NHS Trust.

A Prohibition notice has been issued against Glan Hafren NHS Trust. Prior to 1996–97, notices against the NHS cannot be identified from HSE's computer databases. HSE holds no information on the number of "breaches" which do not result in a prosecution of the issuing of an Improvement or Prohibition Notice.
