HC Deb 04 February 1998 vol 305 c639W
Mr. Burstow

To ask the Parliamentary Secretary, Lord Chancellor's Department if he will review the statutory time limit on the right of mortgagors to pursue shortfall debts after judgment. [27423]

Mr. Hoon

The Government do not intend to conduct a separate review of the statutory time limit applicable to mortgage debts. A Comprehensive review of the law of limitation periods has already been undertaken by the Law Commission, with a view to simplification and rationalisation of the law. In January this year, the Commission published a Consultation Paper seeking the views of interested parties on its provisional proposals for reform. We will consider the recommendations made when the Law Commission completes its Report. The Government do not plan to modify the law relating to limitation of actions before then.
