asked Her Majesty's Government:

Whether a derogation from the principle of non-discrimination as laid down by Article 48(3) of the treaty establishing the European Community can permanently invalidate the treaty. [HL1444]

Whether the principle of non-discrimination as laid down by Article 48(3) of the treaty establishing the European Community can be invalidated permanently by a derogation. [HL1445]

Article 48(3) of the EC treaty concerns freedom of movement of workers.

The system of national quotas under the common fisheries policy applies without discrimination to all member states and does not invalidate the treaty.
