To ask the Secretary of State for Foreign and Commonwealth Affairs what is the procedure for reviewing prosecutions in cases where the International Court claims responsibility for determining the national location of a trial. [38314]

[holding answer 7 April 1998]: The Treaty establishing the International Criminal Court is still being negotiated. There is no proposal that the Court should have the power to determine the location of trials other than those it conducts itself. We believe that the Court should have jurisdiction only in situations where national legal systems are unable or unwilling to act.
