Mr. Livingstone

To ask the Parliamentary Secretary, Lord Chancellor's Department what salary the clerk to the justices in Brent receives as chief executive in addition to his salary as clerk. [25156]

Mr. Evans

Under the provisions of section 26A of the Justices of the Peace Act 1979, justices' chief executives and justices clerks are employed under contract by magistrates courts committees, on terms which the courts committees decide. I do not have access to individual contracts.

Mr. Livingstone

To ask the Parliamentary Secretary, Lord Chancellor's Department what were the costs to public funds arising from the recent successful appeal by the Brent court clerk to an industrial tribunal against her dismissal; if he will provide a breakdown of the costs; and if he will make a statement about the circumstances that led to this case. [25160]

Magistrates courts are locally managed by magistrates courts committees under the provisions of the Justices of the Peace Act 1979. The Department has not been notified of either the amount of the legal costs incurred by the magistrates courts committee, or the amount of the agreed settlement, made in 1994, between the magistrates courts committee and the former employee.

These amounts would have been paid from locally held funds, and no request for additional cash-limited grant was made to cover these payments.
