Mr. Heppell

To ask the Secretary of State for the Home Department if he is informed of all decisions of the immigration authorities to allow entry to the United Kingdom outside the normal immigration rules. [1045]

Mr. Kirkhope

It would not be practical for my right hon. and learned Friend to be informed personally of every occasion on which discretion is exercised on his behalf outside the immigration rules.

To ask the Secretary of State for the Home Department in what circumstances(a) police and (b) immigration officials have the right to instruct immigration officials to allow someone permanent leave to remain in the United Kingdom when that person has no legal right to do so. [1045]

Mr. Kirkhope

Leave to remain is granted under the immigration rules on my right hon. and learned Friend's behalf. The police have no locus in the matter. Discretion to grant indefinite leave to remain outside the rules is exercised sparingly, in accordance with instructions or in exceptional compassionate circumstances.
