HC Deb 24 May 1995 vol 260 c644W
Mr. Gordon Prentice

To ask the President of the Board of Trade if he will make a statement on the application of section 5(3) of the Public Records Act 1958 to information on inside dealing under section 179 of the Financial Services Act 1986. [25510]

Mr. Heseltine

Section 179 of the Financial Services Act 1986 prohibits the disclosure of certain information obtained for the purposes of, or in the discharge of functions under, that Act. Section 179 is therefore a statutory bar on disclosure of the type referred to in section 5(3) of the Public Records Act 1958. Section 5(3), which otherwise places a duty on the Keeper of Public Records to arrange that reasonable facilities are available for public inspection of public records, does not apply to information covered by section 179. Therefore such information will not be made available in the Public Record Office.
