To ask the Secretary of State for Social Security if he will make a statement on implementing the fallow period when the delay for late payment of attendance allowance is due to administrative error. [16159]

Under the DSS special payments arrangements, compensation may be considered where payment of benefit has been delayed unduly as a result of clear official error.

The fallow period is the period which must elapse before consideration can be given to the payment of compensation. The fallow period until 1993 was one year for all benefits, including attendance allowance.

The fallow period for AA and disability living allowance was reduced to eight months from 1 April 1995.
