To ask the Secretary of State for Scotland what arrangements are in place to ensure the supervision and safety of children in playgrounds in(a) nursery, (b) primary and (c) secondary schools in Scotland; and if he will make a statement.

Education authorities have a common law duty to care for all pupils when under their charge. In addition, the Schools (Safety and Supervision of Pupils) (Scotland) Regulations 1990 impose a specific statutory duty on education authorities to take reasonable care for the safety of pupils when under their charge. In primary schools with 50 or more pupils in attendance, and in special schools, the regulations require education authorities to ensure that pupils are supervised by at least one adult when in a playground during any break time.
