To ask the Secretary of State for Scotland if he will make a statement on the implementation in Scotland of notification of proscribed processes under part B block 1 authorisations of the Environmental Protection Act 1990.

[holding answer 18 May 1993]: Part IV of schedule 3 of the Environmental Protection (Prescribed Processes and Substances) Regulations 1991 SI 1991 No. 472, prescribes for "part B" processes in Scotland by reference to blocks of process descriptions, the dates from which application may be made for authorisation to carry on an existing process. Applications were to be submitted for the first block no earlier than 1 April 1992 and not later than 31 July 1992. Therefore, to carry out a block 1 process after 31 July 1992 without applying for an authorisation under section 6 of the Environmental Protection Act 1990 is an offence under the Act.
