asked Her Majesty's Government:

Whether the Home Secretary's letter to colleagues, published in the Independent and the Guardian on 1st May, involving a decision in the High Court by Ogden J on the implications of the EC Acquired Rights Directive on market testing, will lead to any reconsideration of government policy on this issue; whether they propose to finance an appeal against the judgment by one of the parties; and if so what statutory basis there would be for such a decision and whether the costs involved would be separately identified in the departmental accounts submitted to the Comptroller and Auditor General.
