To ask the Secretary of State for the Environment (1) what proportion of development undertaken by local highways authorities is permitted by part 13 of the Town and Country Planning General Development Order 1988;

(2) if he will seek to amend part 13 of the Town and Country Planning General Development Order 1988 to reduce the scope of permitted development rights for development by local highway authorities;

(3) what examination he has made of whether any development permitted by part 13 of the Town and Country Planning General Development Order 1988 is likely to give rise to significant environmental effects.

My hon. Friend the Minister for Housing and Planning announced on 7 July 1992 a review of all permitted development rights which could have significant environmental effects. That review is near completion, and a consultation paper will be issued shortly.

As permitted development rights do not require a planning application, information on the proportion of development that is undertaken by local highway authorities without express consent is not available.
