§ Mr. Kenneth CarlisleLegislation already exists to control the use of parking places reserved for disabled badge holders, both on-street and in local authority car parks, which have been designated by an Order made under the Road Traffic Regulation Act 1984. In both circumstances the police and local authority have powers to prosecute offenders and those parked on-street can be issued with a fixed penalty notice. If prosecuted, able-bodied people who misuse such spaces face a fine of up to £1,000. The level of enforcement given to these offences is a matter for individual chief constables and local authorities to determine.
117WIn privately owned and operated car parks, it is for individual operators to take whatever steps they consider necessary to see that reserved spaces are not misused.
