To ask the Secretary of State for the Environment (1) what is the basis for excluding the Kaolin mounds of Cornwall from the draft regulations under section 143 of the Environmental Protection Act 1990;

(2) what is the basis for excluding the old tin mining areas of Cornwall with arsenic contaminant from the draft regulations under section 143 of the Environmental Protection Act 1990;

(3) what is the basis of excluding the former zinc mining areas with cadmium contaminant from the draft regulations under section 143 of the Environmental Protection Act 1990.

The uses of land listed in the draft regulations for initial coverage by registers are those considered most likely to give rise to contamination. The china clay waste mounts of Cornwall do not give rise to significant potential for contamination. Current research being undertaken for my Department is identifying, in general terms, areas of metalliferous mining and the occurrence of natural contaminants associated with mined ground.
