To ask the Secretary of State for Health if she will make a statement on the outcome of the investigation into the use of the Buxton chair to restrain patients.

A press report earlier this year about the Buxton chair was prompted by a discussion document published by the organisation Counsel and Care on the use of restraint in residential care. Counsel and Care found no evidence of the chair being used incorrectly. Misuse should not occur in a care home where the principles underlying the Registered Homes Act 1984 have been adopted and where the guidance issued under the Act is being followed. The possibility of the inappropriate or unnecessary restraint of any resident is a matter for serious concern. This is recognised in the Act which gives registration authorities power to act against any establishment where bad care practice is found.
