Whether following the implementation of Section 46 of the Criminal Justice Act 1991, the 44WA Parole Board will still review the cases of prisoners liable to removal from the United Kingdom; and, if not, what system of review will operate as a basis for the Home Secretary's decision in these cases.
Earl FerrersUnder Section 46, of the Criminal Justice Act 1991, the Secretary of State may release on licence a long term prisoner who is liable to removal from the United Kingdom, without receiving a recommendation for release from the Parole Board. The Government are still considering how the cases of such prisoners should be reviewed.
