Mr. Gapes

To ask the Secretary of State for Transport what powers he has to offerex-gratia payments for cases where the provisions of the Land Compensation Act 1973 cannot be waived.

Mr. Norris

The Secretary of State is not empowered to make payments under the Land Compensation Act 1973 other than in accordance with the provisions of that Act.

Mr. Gapes

To ask the Secretary of State for Transport what powers he has to vary the amount of compensation to be paid in cases where his Department admits to a careless error.

Mr. Norris

My right hon. Friend is only permitted to make payments as prescribed in the statute, or on anex-gratia basis in order to relieve hardship caused by official failure or unreasonable delay.

To ask the Secretary of State for Transport what plans he has to amend the Land Compensation Act 1973.

Mr. Norris

I understand that my right hon. and learned Friend the Secretary of State for the Environment, who has responsibility for this matter, has no plans to amend the land Compensation Act 1973.
